With 19 years remaining on Sam “SBF” Bankman-Fried’s sentence, his legal team is set to argue before the appellate court why a panel of judges should consider overturning his conviction or reducing his 25-year prison sentence. Oral arguments are scheduled for Tuesday at the US Court of Appeals for the Second Circuit.

Key Arguments from the Defense

While the specifics of the appeal remain somewhat opaque, SBF’s legal team indicated in their initial filing from September 2024 that they intend to argue SBF was “never presumed innocent.” They contend that they were restricted from presenting crucial information to the court regarding the solvency of the FTX exchange. The September 2024 appeal stated, “From day one, the prevailing narrative—initially spun by the lawyers who took over FTX, quickly adopted by their contacts at the US Attorney’s Office— was that Bankman-Fried had stolen billions of dollars of customer funds, driven FTX to insolvency, and caused billions in losses.”

Emerging Developments in the Case

The appeal further asserts that “Now, nearly two years later, a very different picture is emerging—one confirming FTX was never insolvent, and in fact had assets worth billions to repay its customers. But the jury at Bankman-Fried’s trial never got to see that picture.” Following FTX's collapse in November 2022, U.S. authorities extradited Bankman-Fried from the Bahamas to face charges including money laundering and fraud. A jury convicted him on seven felony counts in November 2023, leading to a 25-year prison sentence in March 2024.

Political Implications and Potential Presidential Pardon

The high-profile case has drawn significant attention from industry stakeholders and lawmakers alike, given SBF's extensive political contributions. The appellate court will determine whether to grant Bankman-Fried a new trial or uphold his conviction in New York. Subsequent to his conviction and sentencing, Bankman-Fried has seemingly attempted to align himself with Republican and right-leaning politicians, possibly aiming to attract the attention of former U.S. President Donald Trump, who has previously expressed willingness to pardon or commute the sentences of cryptocurrency figures who support him or have connections to his family.

Precedent of Pardons in Crypto Sector

In January, Trump pardoned Silk Road founder Ross Ulbricht, who was serving a life sentence, ostensibly appealing to libertarian voters ahead of the 2024 election. More recently, he pardoned former Binance CEO Changpeng “CZ” Zhao, who served four months in prison in 2024 for violating the U.S. Bank Secrecy Act. This act has fueled speculation among crypto enthusiasts that SBF might be next in line for a pardon, although as of Tuesday, the White House has made no such announcement.
